E-2 Family Benefits: Spouse Work Authorization, Dependent Rights, SSN

Since January 30, 2022, E-2 spouses are admitted under the E-2S classification with automatic work authorization. The I-94 admission record showing E-2S is itself evidence of work authorization; applicants typically do not need a separate Employment Authorization Document (EAD) for I-9 purposes.

Before January 2022, E-2 spouses commonly filed Form I-765 to obtain a physical EAD card. Current practice relies on the I-94 E-2S annotation directly. Applicants who already hold an unexpired EAD continue to use it; new arrivals typically present the I-94 instead.

Unmarried children under 21 of the E-2 principal qualify as E-2 derivative dependents. They may study in the U.S. at K-12 or university level without separate F-1 status. Children do not receive work authorization under the derivative E-2; upon turning 21, they typically transition to another status.

Public K-12 schools commonly enroll E-2 dependents using the I-94 admission record, passport, and proof of residency. Schools typically do not require a Social Security Number for enrollment; SSN may be requested for record-keeping but is not a legal prerequisite.

E-2 principals and E-2S spouses with work authorization commonly apply for an SSN at a Social Security Administration field office. The application requires the I-94 record, passport, and (for the principal) the visa stamp. Processing commonly takes a few weeks; the card is mailed to the applicant's address. Children without work authorization typically do not receive an SSN.
